Official Rules for the
Who Was? Sweepstakes

NO PURCHASE NECESSARY. A PURCHASE WILL NOT ENHANCE YOUR CHANCES OF WINNING.

Open to residents of the fifty United States and the District of Columbia, ages 8-12

How to Enter:

  1. To enter the Who Was? Sweepstakes ("Sweepstakes"), complete the official Sweepstakes entry form, voting for your favorite Who Was? book. The entry form must contain your full name, your submitting teacher/librarian’s name, your school/library name, your school/library address, your school/library phone number, your submitting teacher/librarian’s email address, and favorite Who Was? title. Completed entries will be accepted via U.S. mail only and must be submitted by teachers or school librarians. Entries must be in one envelope per school/library and mailed to: Penguin Young Readers School and Library Marketing Department, 345 Hudson Street, New York, NY 10014, Attention: Who Was? Sweepstakes. Entries must be postmarked by April 30, 2012 and received on or by May 7, 2012. No mechanically reproduced or computer-generated entries allowed. Limit one entry per student. By entering this sweepstakes, the submitting teacher/librarian agrees to receive the Penguin Young Readers School and Library Marketing e-newsletter.
  2. For whom you vote on your entry form will have no impact on your Sweepstakes eligibility.
  3. Entries are void if they are in whole or in part illegible, incomplete or damaged. No responsibility is assumed for late, lost, damaged, incomplete, illegible, postage due or misdirected entries.
  4. Penguin Young Readers Group, a division of Penguin Group (USA) Inc. ("Sponsor"”) and its parent, subsidiary and affiliated companies are not responsible for technical malfunctions of any kind which may limit the ability to play or participate, or by any human error which may occur in the processing of the entries in this Sweepstakes. If for any reason the Sweepstakes is not capable of being conducted as described in these rules, Sponsor shall have the right to cancel, terminate, modify or suspend the Sweepstakes.

Winners:

  1. From all eligible entries received, winners will be chosen in a random drawing held on or about May 14, 2012 by Sponsor, whose decisions concerning all matters related to this Sweepstakes are final and binding.
  2. The teachers/librarians who submitted winning entries will be notified by email and/or telephone. The odds of winning depend on the number of eligible entries received.

Prizes:

  1. One (1) Grand Prize Winner’s submitting school/library will receive:
    • A dedication to the winning school or library in an upcoming Who Was? title
    • A complete set of Who Was? Books with a bobble head display (Approximate Retail Value ("ARV"”): $600.00).

  2. One (1) First Place Prize Winner’s submitting school/library will receive:
    • A set of Penguin non-fiction titles (selected by Penguin Young Readers Group) (ARV: $300.00).
  3. One (1) Second Place Prize Winner’s submitting school/library will receive:
    • A set of Penguin non-fiction titles (selected by Penguin Young Readers Group) (ARV: $150.00).
  4. In the event that there are an insufficient number of entries, Sponsor reserves the right not to award the prizes.

Eligibility:

  1. Open to residents of the fifty United States and the District of Columbia, ages 8-12, who submit their entry through a library or school. Void where prohibited by law. All state and local restrictions apply.
  2. Employees, their immediate family members and individuals living in the same household, of Sponsor, its parent, subsidiary or affiliated companies or the agencies of any of them and/or author(s) are not eligible for this Sweepstakes.

General:

  1. No cash substitution, transfers or assignments of prizes allowed. In event of unavailability, Sponsor may substitute a prize of equal or greater value.
  2. All expenses, including taxes, (if any) on receipt and use of prizes are the sole responsibility of the winners.
  3. Winners may be required to execute an Affidavit of Eligibility and Release ("Affidavit") and, if so, the Affidavit must be returned within fourteen (14) days of notification or another winner will be selected. If a selected winner is under 18 years of age, his/her parent or legal guardian will be required to sign the Affidavit. Should the ARV of the prize equal or exceed $600.00, winners’ school or library shall be required to provide a Federal Taxpayer Identification Number to Sponsors for issuance of a 1099 Form.
  4. By accepting a prize the winners grant to Sponsor the right to use their names, likenesses, and biographical information in advertising and promotional materials, including posting on the Sponsor’s websites, without further compensation or permission, except where prohibited by law.
  5. By competing in the Sweepstakes and/or accepting a prize, entrants release Sponsor, its parent, subsidiaries or affiliated companies or the advertising agencies of any of them and the authors of any books promoted hereby from any liability, injuries, damages, cost or expense, arising out of or relating to participation in this Sweepstakes or the acceptance, possession, use or misuse of any prizes.
  6. Any dispute arising from this Sweepstakes will be determined according to the laws of the State of New York, without reference to its conflict of law principles, and the entrants consent to the personal jurisdiction of the state and federal courts located in New York County and agree that such courts have exclusive jurisdiction over all such disputes.

Winners List:
